Stichting SPOONK, hereinafter referred to as SPOONK, processes personal data. Due to the nature of our activities, we have certain data about you. In this statement, we explain which data we process, when and why we do this.

We attach great importance to protecting your personal data and handle it with great care. Every data processing we do complies with the current privacy laws and regulations (AVG).

Applicability
This privacy statement applies to the processing of data by SPOONK.

Processing
There are two situations in which we receive, use, and process your data.

1. You are an artist and have a presentation with us, in the broadest sense of the word, in the building at Kleine Hoogstraat 17, 8911HD Leeuwarden or in the public space.

2. You are a visitor and/or interested and you come to visit or participate in a presentation, in the broadest sense of the word, in the building at Kleine Hoogstraat 17 or in the public space.

What data do we collect and why?
In general, we only collect data that is necessary for our activities.

Artist
When you have a presentation with us as an artist, we process a number of data from you, namely:

• (company) name

• Address

• Place of residence

• Phone number

• Email address

• IBAN

We process this data because it is necessary for us to comply with the legal requirements for good business operations. In addition, we need your email address and phone number to be in contact with you during the preparation, during, and after the presentation.

In addition to the above data, we also process the following data:

• Date of birth

• Place of birth

• Photo and video material

We process this data to support the presentation material and to promote your presentation via social media, flyers, and the press. In addition, we also use the photo and video material for our archive.

Visitor/interested
As a visitor or interested person, you will receive an invitation to a presentation, visit a presentation, or receive our newsletter. It may also be that, at a presentation, you decide to purchase a work. For all these matters, we need the following data from you:

Invitation

• Name

• Address

• Place of residence

• Email address

Without this data, we cannot reach you and invite you to a presentation. We only have this data if you have given it to us and have given us permission to process this data.

Newsletter

• Email address

We send the newsletter via email and need your email address for this. We only process this with your permission.

Purchases
When you visit a presentation, you may decide to purchase a work. When you proceed with the purchase of a work, we process the following data from you:

• Name

• Address

• Place of residence

• IBAN

We process this data because we are legally obliged to keep accounts.

Visit presentation
During a presentation, we do not, in principle, process personal data. Unless you come to us for the first time and decide that you want to receive invitations or the newsletter in the future, or proceed to purchase one of the presented works. In that case, we process the data as described above. During a visit to a presentation, we take photos and videos which we post on our website or social media.

Photos and Videos
SPOONK takes photos and videos during a presentation. We post these on our website and on social media. We do this for our archive and also to show what we do as a platform. This is part of our business operations.

Your rights
You can always gain insight into the data we have about you. You can also have your data adjusted or deleted. You can do this by sending an email to: info@spoonk.com Please note! Sometimes we cannot delete data even if you would like us to. This is because we are required by law to keep this data for a number of years. If this happens, we will of course explain why we cannot or may not delete your data at that time.

How do we secure your data?
Security
SPOONK takes appropriate technical and organizational measures to secure your data against unauthorized access, destruction (whether deliberate or not), dissemination, or any other form of unlawful processing of your data. Your data is only visible and accessible to the management of SPOONK who need it to carry out the activity.

Retention
We keep your data for the purposes as stated earlier in this document. We do this for no longer than is necessary.

Third parties or processors
We may share your data with another company. For example, for filing taxes, or for sending the newsletter via Mailchimp. These are processors. We only provide the necessary data to the processor, and these processors are required to protect your personal data. We enter into an agreement with all processors that includes the above-mentioned matters.

Intellectual property rights
All information on our website (Texts, logos, illustrations, and photos) are our property or are included with permission. It is not allowed to copy, forward, or make this information available for a fee, without our permission.

Data breach notification obligation
When we have a data breach, we are obliged to report this to the data protection authority within 72 hours. Have you discovered a possible data breach with us? Please report this as soon as possible via info@spoonk.com mention in your email the data with which we can contact you and briefly describe the (possible) data breach.
